In plain terms

  • We collect what we need to run a marketplace: who you are, your business, and what you list or ask for. We do not sell personal information.
  • If you are a buyer, the suppliers you send a request to see your name, business, job details and list. No one else does.
  • If you are a supplier, your business details and listing are public. Your prices are shown to buyers and never to other suppliers.
  • Your data is stored with service providers we name below. You can ask us for a copy of what we hold about you, or ask us to correct or delete it.

1.Who we are

  1. 1.1This policy is issued by The Trade Yard Pty Ltd (ACN 702 571 122, ABN 92 135 934 189) of 2A Shaw Street, Fawkner VIC 3060 ("we", "us"), which operates The Trade Yard at thetradeyard.com.au. We handle personal information in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth), whether or not we are required to, and with the Spam Act 2003 (Cth).

2.What we collect

  1. 2.1Account information: your name, email address, your business or trading name, your trade, and a mobile number if you give one. If you sign in with Google, Google gives us your name and email address and a token that lets us confirm who you are; we do not receive your Google password or contacts.
  2. 2.2Buyer activity: the materials lists you keep and send, job names, site postcodes and addresses, notes to suppliers, the suppliers you select or hide, quotes you receive and accept, orders you place, your chosen search distance, and your answers to questions about whether an order arrived as quoted.
  3. 2.3Supplier information: the business name, ABN, address, contact details, delivery areas, pickup hours, payment terms and trade account statements you give us; your catalogue, prices, photos and descriptions; your quotes; and, through Stripe, your subscription and payment status. Stripe holds your card details; we do not see or store them.
  4. 2.4Trade account applications: the details you enter when you apply to a supplier for a trade account, which may include your ABN, are sent to that supplier. We keep a record that the application was made.
  5. 2.5Usage information: pages viewed, actions taken, the device and browser used, IP address, and timestamps. We use our own systems to record this; at present we do not use third-party advertising or analytics trackers. We use cookies to keep you signed in and browser storage to keep draft lists on your device.
  6. 2.6Correspondence: what you send us by email or through the platform.

3.Why we collect it

  1. 3.1To create and secure your account; to send your requests to the suppliers you choose and their quotes back to you; to match lists to catalogues; to show suppliers' listings to buyers; to run subscriptions and billing; to send you the emails the platform needs to send, such as sign-in links, request and quote notifications and order updates; to show and moderate order feedback; to verify supplier businesses; to respond to you; to keep the platform working, safe and lawful; and to understand how the platform is used so we can improve it.
  2. 3.2We will only send you marketing about The Trade Yard if you have agreed to it, and every marketing email includes a way to opt out. Emails the platform must send to run your account or your requests are not marketing.

4.Who we share it with

  1. 4.1Suppliers you send a request to receive your name, business name, job name, site postcode or address, list, note and, if you gave one, your mobile number, so they can quote and deliver. Suppliers you order from receive what they need to fill the order. Suppliers you apply to for a trade account receive your application. Suppliers see aggregate feedback about their own orders and, for an individual answer, which order it relates to.
  2. 4.2Buyers see a supplier's business name, suburb, ABN verification status, delivery and pickup facts, trade account statement, catalogue and prices, and aggregate order feedback. Buyers do not see a supplier's contact details until the supplier quotes or is sent a request.
  3. 4.3We do not show one supplier's prices, quotes or catalogue to another supplier, and we do not sell personal information or pricing data to anyone.
  4. 4.4Service providers that process data for us: Supabase (database, authentication and file storage), Vercel (application hosting), Resend (email delivery), Stripe (subscription payments), and Google (sign-in, where you choose it). Each is bound to use the data only to provide its service to us.
  5. 4.5We may disclose information where the law requires, to protect the safety of a person, to enforce our terms, or to a buyer of our business, who would take on this policy.

5.Where it is stored

  1. 5.1Our database and files are hosted by Supabase in Sydney, Australia (ap-southeast-2). Our application is served by Vercel, and email is sent by Resend; both operate from the United States and may process data there. Stripe processes payments in Australia and the United States. By using the platform you consent to your information being handled by these providers in those places. Each provider is subject to contractual obligations about how it handles the data.

6.How we protect it

  1. 6.1Access to the database is controlled by row-level security so that each account can only read and write what it is entitled to. Data is encrypted in transit and at rest by our hosting providers. Sign-in is by email link or Google; we do not store passwords. Access to administration tools is limited to our staff. No system is perfectly secure, and we will notify you and the Office of the Australian Information Commissioner of an eligible data breach as the Privacy Act requires.

7.How long we keep it

  1. 7.1We keep account information while your account is open. Requests, quotes and orders are kept as records of the transaction for 7 years, because both buyers and suppliers may need them. If you close your account we remove your name and contact details from your profile and keep the transaction records in a form that still identifies the business party to each quote, as the other party is entitled to. A supplier's catalogue is deleted or de-identified 30 days after its listing ends, after the export period in the Subscription Agreement. Usage logs are kept for no more than 12 months.

8.Access, correction and deletion

  1. 8.1You can see and change most of your account details in the platform. You can ask us for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it, by emailing info@thetradeyard.com.au. We will respond within 30 days. We may decline to delete information we must keep by law or that another party to a transaction is entitled to, and we will tell you if so.

9.Cookies and browser storage

  1. 9.1We use a cookie to keep you signed in and browser storage on your device to hold draft lists and your preferences. These are needed for the platform to work. We do not at present set third-party cookies or use advertising trackers. If that changes, we will update this policy and, where the law requires, ask for your consent.

10.Complaints

  1. 10.1If you think we have mishandled your personal information, email info@thetradeyard.com.au and we will investigate and respond within 30 days. If you are not satisfied, you may complain to the Office of the Australian Information Commissioner at oaic.gov.au.

11.Changes to this policy

  1. 11.1We may update this policy. Material changes will be notified by email or on the platform at least 14 days before they take effect. The date at the top is the date of the current version.
